On June 16, 2022 USCIS updated the “Frequently Asked Questions” regarding the efforts of USCIS to use up the unprecedented number of employment-based Green Cards available in fiscal year 2022, which ends September 20, 2022. USCIS estimates that 280,000 employment based Green Cards will be available, double the usual annual total. This is due to the large number of family based visas that have gone unused due to consular closings related to COVID. USCIS is urging anyone with an approved I-140 with a current priority date to either file an adjustment application now, or apply to transfer a pending adjustment attached to a different I-140 that does not have a current priority date. In most cases that means transferring the adjustment from a non-current EB-3 petition to a current EB-2 petition. Click here to read the new FAQs.
